ACTIVITY STATEMENT OF PUBLIC UNION

”EUROPEAN SOCIETY OF OCCUPATIONAL SAFETY & HEALTH”

INTRODUCTION

Regulations on activities (hereinafter – the Regulations) PUBLIC UNION “EUROPEAN SOCIETY OF OCCUPATIONAL SAFETY & HEALTH” (hereinafter – Union, ESOSH) developed on the basis of the Union Charter and the Code of Conduct for the members of the Union, to regulate the order of input, transfer, deduction or exclusion from the Union of its participants. The Regulations is the basis for the activities of the bodies of the Union to ensure the rights of its members and to control the implementation of the duties of the Union`s members.
1. DIRECTION OF ACTION
1.1 The Union carries on its activities in the field of occupational safety and health, and it directs it to protect lives and health of people in the workplace, using existing opportunities to disseminate the best world-wide experience in reducing occupational injuries.
1.2 The main courses of action of the Union are:
– Development of professional competence of specialists in occupational safety and health,
– Dissemination of knowledge of skilled, experienced and competent European professionals in the field of occupational safety and health,
– Consultations and information and technical support of organizations of different forms of ownership in the field of occupational and industrial safety,
– Establishing relationships with international and local organizations to increase the level of safety at the organizations of different forms of ownership,
– Increasing the standards of occupational safety based on the legislation of the European Union and conventions of the International Labour Organization in the field of occupational safety,
– Distribution and application of a risk-oriented approach and best practices in the field of occupational safety and health.
2. PROCEDURE FOR THE ACQUISITION AND TERMINATION OF ASSOCIATE MEMBERSHIP
2.1 Membership in the Union is voluntary and individual. Members of the Union may be citizens of Ukraine, foreigners and stateless persons who are legally residing in Ukraine, legal entities of different forms of ownership that recognize the Charter of the Union and promote activities aimed at achieving the goals and objectives of the Union.
2.2 The candidate must meet the following criteria for membership in the Union:
– shares the vision, mission and values of the Union,
– participates in achieving the goals and objectives of the Union,
– undertakes to comply with the Code of Conduct of the members of the Union,
– confirms his/her professional experience and is ready to constantly improve,
– has an impeccable business reputation.
2.3 The decision on admission to associate members of the Union is made based on the fulfilment of the requirements set out on the official website of the ESOSH, namely:
– application for entry into ESOSH,
– summary (for individuals) or company profile (for legal entities) in an arbitrary form, confirming professional activity (see Clause 4.2. Requirements for qualification of ESOSH “Specialist”),
– successful passing of testing on knowledge of the ESOSH participant’s Code of Conduct,
– consent to the processing of personal data,
– agreement to comply with the Code of Conduct and this Regulation in the activities related to ESOSH.
2.4 The decision on the admission of legal persons to associate members of the Union shall be adopted in addition to the requirements of paragraph 2.3, on the basis of the results of the audit on compliance with the criteria set out in paragraph 2.2. of this Regulation. The audit is carried out by the ESOSH or the organization which is authorized by the Union , with established cycles, and aimed at maintaining an integral reputation in the field of occupational safety and health in a legal entity, a member of ESOSH.
2.5 The Union may require additional information (documents) from the candidates to complete the acceptance procedure. Associate membership in ESOSH is confirmed by a corresponding letter from ESOSH Board and entry in the register of Associate Members of the Union. The Board reserves the right to refuse to accept a candidate to associate members of the Union without explaining the reasons.
2.6 Associated membership in the Union shall be terminated in cases:
– exit from the Union at will,
– an exclusion from the Union, in accordance with the decision of the Board, in connection with violation of the requirements of this Statute, the Regulations on the activities of the Union and the Code of Conduct of the members of the Union,
– if the activity of a member contradicts the purpose and objectives of the Union,
– if a member has lost contact with the Union without a reasonable excuse,
– death of a member of the Union.
2.7 Participation in the Union for its members is free of charge.
3. RIGHTS AND OBLIGATIONS OF MEMBERS OF THE UNION AND ASSOCIATED MEMBERS OF THE UNION
3.1 The rights of an associate member of the Union:
– to take part in all events held by the Union, except in cases determined by the General Meeting of the Members of the Union,
– to participate in the work of permanent and temporary commissions, sections, departments, other non-governmental bodies created by the decision of the authorized bodies of the Union,
– to provide the relevant bodies of the Union with proposals concerning the activities of the Union,
– to contact the Union authorities for the protection of its rights and legitimate interests directly related to the activities of the Union,
– to take part in mass events organized by the Union on special (privileges) approved by the Council, if such conditions are established,
– to use the Union Association foreseen discounts for affiliated members from the partners of the Union,
– to take part in the social and charitable activities carried out by the Union,
– to use in its professional activity information provided by the Union in open sources, information about its status of acquired membership in the Union,
– voluntarily freely acquire and terminate associate membership in the Union.
3.2 Responsibilities of an associate member of the Union:
– in its activities, insofar as it relates to the Union, be guided by the Charter of the Union and the Statute and other internal documents of the Union,
– to actively participate in the achievement of the goals and objectives of the Union, to contribute in every way to the Union in its activities,
– to carry out the decisions of the authorities of the Union,
– refrain from actions and statements that contradict the policy, purpose and objectives of the Union, and may also be detrimental to its business reputation,
– not to violate the rights of other members of the Union, including Associated members of the Union,
– notify the Union of its actual contact details and data on their change,
– to confirm the activity of its associate member status, in the order and terms stipulated by the Union.
4. QUALIFICATION LEVELS OF ASSOCIATED MEMBERS OF THE UNION
4.1 The Union enables its associated members – natural persons to increase their competence within the Union or beyond and to confirm their level of qualifications on the basis of honesty, impartiality and objectivity. For this purpose, within the framework of the Union there are 4 (four) qualification levels for specialists in the field of occupational safety and health, which take into account professional experience and professional knowledge:
– Level 1 Specialist
– Level 2 Accredited specialist
– Level 3 Certified expert
– Level 4 Chartered Expert
Advancement at qualification levels is carried out by associate members at will, is not compulsory, and allows to carry out continuous professional growth.
4.2 Requirements for the qualification levels of the associated ESOSH members are given in paragraphs. 4.2.1 – 4.2.4. The candidate becomes the level of qualification for compliance with all the requirements put forward at each level:
  • 4.2.1 Level 1 Specialist (abbr. S ESOSH)
  • Term 1. Practical work experience in the positions of engineer, specialist, manager of occupational safety, industrial safety at least 2 years at an enterprise with a staff of more than 20 people, or for graduates of higher education institutions – specialized higher education in the specialty “Occupational Safety” (not lower than bachelor’s degree).
  • Term 2. 100% passing testing on knowledge of the Code of Conduct of ESOSH participants.
  • 4.2.2 Level 2 Accredited Specialist (abbr. AS ESOSH)
  • Term 1. Practical work experience in the positions of engineer, specialist, manager of occupational safety, industrial safety at least 2 years at an enterprise with a staff of more than 20 people, or for graduates of higher education institutions – specialized higher education in the specialty “Occupational Safety” (not lower than bachelor’s degree).
  • Term 2. The ESOSH specialist who has the ESOSH Certificate on Occupational Safety and Health Management (21 academic hours) has passed, or has undergone a similar course under the program of world-recognized Occupational Safety and Health Centres (IOSH Managing Safely, NEBOSH Award or their equivalents).
  • 4.2.3 Level 3 Certified Expert (abbr. CE ESOSH)
  • Term 1. Practical work experience at the position of engineer, specialist, manager of occupational safety, industrial safety at least 5 years at an enterprise with a staff of more than 50 employees.
  • Term 2. A member of ESOSH 1 or 2 level ESOHS Certificate of Occupational Safety and Health Management (130 academic hours), or a similar course under the program of world-recognized Occupational Safety and Health Centres (NEBOSH IGC or its equivalents).
  • Term 3. The ESOSH participant, who supports the Continuing Professional Development Program (ESOSH Program CPD), is posted on the official ESOSH website, which provides information on the professional activity and its further planning.
  • 4.2.4 Level 4 Chartered Expert (abbr. ChE ESOSH)
  • Term 1. Practical work experience at the position of engineer, specialist, manager of occupational safety, industrial safety at least 5 years at an enterprise with a staff of more than 50 employees.
  • Term 2. Participant of ESOSH level 1, 2, 3 who has an ESOSH Certificate on Occupational Safety and Health Management degree (not less than 1,5 years of correspondence training), or has passed a similar course under the program of the world-recognized centres of work safety NEBOSH Diploma, NVQ5, or their equivalents.
  • Term 3. The ESOSH participant supports the Continuing Professional Development Program (ESOP Program BPR), posted on the official ESOSH website, which provides information on the ongoing professional activities and their further planning.
  • Term 4. ESOSH participant successfully interviewed other ESOSH qualified experts to test the level of knowledge, practical experience of problem solving using a risk-oriented approach.
4.3 Educational programs, seminars, advanced training courses ESOSH are conducted by the Union or an authorized organization based on common market relations. The decision on obtaining a qualification level is taken by the Board of ESOSH based on the application of the associated ESOSH member, the results of the verification of knowledge in the training and certificates received.
5. BODIES OF MANAGEMENT OF THE UNION
5.1 The bodies of management of the Union are: the General Meeting of the members of the Union, the Board, the Supervisory Board, whose activities are governed by the Charter of the Union.
5.2 General meeting of the Union members is the supreme body of the Union, which has the right to make decisions on any issues of its activities, including those that fall within the competence of the Board. Regular General Meetings are convened by the Board annually. Members of the Union may be elected by the Board of Associate Members of the Union.
5.3 Board of the Union is the governing body of the Union for the period between the General Meeting, is elected for a term of 5 years and performs functions for managing its current, organizational activities. The Board consists of: the Chairman of the Board, the General Director, whose functional duties are enshrined in the Charter of the Union.
5.4 Supervisory Board is an advisory and supervisory body of the Union. Members of the Supervisory Board have the right to participate in the meeting of the Board of the Union with the right of deliberative vote.
FINAL PROVISIONS
This Regulation enters into force from the date of its approval by the Board of the Union, is obligatory for the implementation of new members of the Union, and operates until the moment of its abolition or adoption of a new provision regulating similar issues, in accordance with the procedure established by the internal regulations of the Union. Changes and amendments to this Regulation shall take effect from the date of their approval by the Board of the Union.
